Code of conduct of Sexual Harrassment in the Workplace

Republic Act No. 7877

Anti-Sexual Harassment Act of 1995 Workplace Environment. Sexual harassment in the workplace is unwelcome sexual advances, requests for sexual favors, or other verbal or physical harassment of a sexual nature. It can happen in person, online, or at work-related functions.

Republic Act No. 7877, also known as the Anti-Sexual Harassment Act of 1995, aims to protect individuals in the workplace from sexual harassment. The law defines sexual harassment, sets employer responsibilities, and establishes procedures for filing complaints.

 

Definition of Sexual Harassment

Sexual harassment occurs in a work-related environment when a person with authority demands, requests, or requires any sexual favor from another individual, whether or not the request is accepted, under circumstances that imply that submission is a condition for employment, promotion, or favorable treatment.

Forms of Sexual Harassment in the Workplace

  • Verbal: Unwanted sexual comments, jokes, or propositions.
  • Non-Verbal: Leering, gestures, or displaying offensive materials.
  • Physical: Unwanted touching, patting, or any form of physical contact of a sexual nature.
  • Quid Pro Quo: Offering job benefits in exchange for sexual favors.

Employer Responsibilities

Employers are required to:

  • Create a safe working environment free from sexual harassment.
  • Implement policies against sexual harassment and inform all employees of these policies.
  • Establish procedures for handling complaints, ensuring confidentiality and non-retaliation.
  • Provide training and awareness programs for all employees.

Filing a Complaint

  • Complaints should be filed with the employer, who is responsible for investigating and taking action.
  • If the employer fails to act, the complaint can be filed with the Commission on Human Rights or other appropriate bodies.
  • 3. The complaint must be treated with confidentiality to protect the identity of all parties involved.

Penalties and Sanctions

  • Violators of RA 7877 may face disciplinary actions, including termination of employment.
  • Any person who violates the provisions of the law shall be penalized by imprisonment of not less than one (1) month nor more than six (6) months, or a fine of not less than Ten Thousand Pesos (P10,000) nor more than Twenty Thousand Pesos (P20,000), or both such fine and imprisonment at the discretion of the court.

RA 7877 is crucial for creating a respectful and professional workplace environment. Employees are encouraged to speak up against sexual harassment, and employers must take proactive steps to prevent and address it.

Code of conduct of Safe Spaces Act in the Workplace

Safe Spaces Act (RA 11313)

Focus: Protecting Individuals from Gender-Based Harassment

Republic Act No. 11313, also known as the Safe Spaces Act, was enacted to address all forms of gender-based harassment, both in physical and online spaces. It expands the scope of harassment beyond the workplace to include public areas, schools, and social media.

Objectives of the Safe Spaces Act

  • Protect all individuals from gender-based sexual harassment in public and private spaces.
  • Promote a culture of respect, equality, and non-discrimination.
  • Strengthen measures against gender-based harassment, both offline and online.

What does the Safe Spaces Act cover?

  • The law covers all forms of gender-based sexual harassment (GBSH) committed in public spaces, educational or training institutions, workplace, as well as online space.
  • Gender-based Streets and Public Spaces Sexual Harassment
  • GBSH in street and public spaces is defined as acts which are committed through any unwanted and uninvited sexual actions or remarks against any person regardless of the motive for committing such action or remarks.

What are the acts of gender-based sexual harassment (GBSH) in public spaces?

  • a. Catcalling or unwanted remarks directed towards a person, commonly done in the form of wolf- whistling (paninipol), misogynistic, transphobic, homophobic, and sexist slurs, as well as unwanted invitations;
  • Sexist remarks or slurs-statements that are indicative of prejudice, stereotyping, or discrimination on the basis of sex, typically against women
  • Homophobic remarks are indicative of fear, hatred or aversion towards persons who are perceived to be or actually identify as lesbian, gay, bisexual, queer, pansexual and such other persons of diverse sexual orientation, gender identity or expression, or towards any person perceived to or actually have experienced same-sex attraction.
  • Misogynistic remarks or slurs- statements that are indicative of the feeling of hating women or the belief that men are inherently better than women
  • Transphobic remarks or slurs-statements that are indicative of fear, hatred or aversion towards persons whose gender identity and/or expression do not conform with their sex assigned at birth.
  • b. Persistent uninvited comments or gestures on a person’s appearance;
  • c. Relentless requests for personal details;
  • d. Statement of sexual comments and suggestions;
  • e. Public masturbation or flashing of private parts, groping, making offensive body gestures at someone, and other similar lewd sexual actions;
  • f. Any advances, whether verbal or physical, that is unwanted and has threatened one’s sense of personal space and physical safety. This may include cursing, leering and intrusive gazing, and taunting;
  • g. Persistent telling of sexual jokes, use of sexual names; and
  • h. Stalking or conduct directed at a person involving the repeated visual or physical proximity, non-consensual communication, or a combination thereof that cause or will likely cause a person to fear for one’s own safety or the safety of others, or to suffer emotional distress.
  • Penalties vary according to the act of GBSH committed and how often a person was convicted for violating the laws.
  • Local government units may come up with ordinances that
    impose heavier penalties for the acts specified in the
    Safe Spaces Act, subject to the conditions
    set under the Administrative Code.

Gender-Based Online Sexual Harassment

  • Gender-based Online Sexual Harassment includes acts that use information and communications technology in terrorizing and intimidating victims through:
  • threats (physical, psychological, and emotional), unwanted sexual misogynistic, transphobic, homophobic and sexist remarks and comments online whether publicly or through direct and private   messages;
  • invasion of the victim’s privacy through cyberstalking and incessant messaging; 
  • uploading and sharing without the consent of the victim any form of media that contains photos, voice, or video with sexual content; 
  • any unauthorized recording and sharing of any of the victim’s photos, videos or any information online;
  • impersonating identities of victims online or posting lies about victims to harm their reputation; or 
  • filing false abuse reports to online platforms to silence victims. 

Gender-Based Online Sexual Harassment

  • Cyberstalking is a form by stalking that is committed through an electronic medium in which online communication takes place. To constitute an offense, the conduct must be manifested through the (repeated) use of electronic communications in stalking.
  • “Stalking” an online profile which is publicly accessible in itself does not constitute an offense.

What are the penalties for online gender-based sexual harassment?

  • The penalty of online GBSH violation is prision correccional in its medium period [imprisonment of six (6) months and one (1) day to two (2) years and four (4) months] or a fine of not less than one hundred thousand pesos (PHP 100,000.00) but not more than five hundred thousand pesos (PHP 500,000.00), or both, at the discretion of the court.
  • If the perpetrator is a juridical person, its license or franchise shall be automatically deemed revoked, and the persons liable shall be the officers thereof, including the editor or reporter in the case of print media, and the station manager, editor and broadcaster in the case of broadcast media. 
  • An alien (foreigner) who commits gender-based online sexual harassment shall be subjected to deportation proceedings after serving sentence and payment of fines.

Where can a victim of online gender-based sexual harassment file a complaint?

  • The victim can file a complaint directly with the National Bureau of Investigation through its Cybercrime Division, the Philippine National Police Anti-Cybercrime Group, or the Office of the Cybercrime of the Department of Justice.

Gender-Based Sexual Harassment in Workplaces

  • Gender-based sexual harassment in the workplace includes the following:
  • A. an act or series of acts involving any unwelcome sexual advances, requests or demand for sexual favors or any act of sexual nature, whether done verbally, physically or through the use of technology such as text messaging or electronic mail or through any other forms of information and communication systems, that has or could have a detrimental effect on the conditions of an individual’s employment or education, job performance or opportunities;
  • B. a conduct of sexual nature and other conduct based on sex affecting the dignity of a person, which is unwelcome, unreasonable, and offensive to the recipient, whether done verbally, physically or through the use of technology such as text messaging or electronic mail or through any other forms of information and communication systems;
  • C. a conduct that is unwelcome and pervasive and creates an intimidating, hostile or humiliating environment for the recipient.
  • Workplaces include all sites, locations, spaces, where work is being undertaken by an employee within or outside the premises of the usual place of business of the employer.

Is Sexual Harassment between peers or by a subordinate to a superior now covered under this law?

  • Yes. The first law to penalize sexual harassment, Anti-Sexual Harassment Act of 1995 (Republic Act No. 7877) recognized that sexual harassment occurs in work, education, and training environments. However, it requires the existence of authority, influence or moral ascendancy between the offender and the offended party. It did not specifically address the issue of “hostile environment” resulting from sexual harassment between peers or co-employees, or those committed against a superior. The Safe Spaces Act addresses these gaps by recognizing that sexual harassment can be committed between peers, or by a subordinate to a superior officer.

  • Yes. Prohibited Acts in Public Spaces

The Safe Spaces Act prohibits the following acts in public areas:

  • Catcalling, wolf-whistling, and lewd gestures.
  • Stalking or following a person.
  • Persistent telling of sexual jokes or remarks.
  • Unwanted sexual advances and touching.

Prohibited Acts in the Workplace

Gender-based sexual harassment in the workplace includes:

  • Requests or demands for sexual favors in exchange for job-related benefits.
  • Verbal or physical conduct of a sexual nature that affects work conditions.
  • Creating a hostile or intimidating work environment through sexual remarks or actions.

Employer Responsibilities

Employers must:

  • Develop and implement anti-sexual harassment policies.
  • Establish a grievance procedure to handle complaints.
  • Conduct training and awareness campaigns for all employees.
  • Ensure a safe and respectful working environment.

Online Sexual Harassment

The Safe Spaces Act also covers online harassment, which includes:

  • Sending sexually explicit messages or images without consent.
  • Cyberstalking and online threats of a sexual nature.
  • Uploading or sharing private photos or videos without permission.

Penalties for Violations

  • Penalties under the Safe Spaces Act may include fines, imprisonment, or both, depending on the severity of the offense.
  • Repeat offenders may face more severe punishments, including longer prison terms and higher fines.

Conclusion

CODE OF CONDUCT

SECTION 1 – Disciplinary Policy

▰It is the company policy to maintain harmonious relationship between. The company and employees, officers, and subordinates and between and among employees. To this end, this Code of Conduct is issued as a form of disciplinary  measures to maintain order and discipline. The Code of Conduct is likewise issued to standardize the admin of disciplinaryprocedure.

▰Infractions and violations of this Code shall be subject to disciplinary actions, ranging from written warning to suspension without pay or termination of employment in case of serious or repeated offenses as circumstances may warrant. It shall be expected that the implementation of this Code shall be assisted by all levels of management staff to establish proper discipline and decorum important to the effective and efficient operation of the company is the management task in implementing this Code.

Section 7 - Application of Penalties

▰In general, the notice of decision shall be issued by: HR/DH Concerned and the General Manager.

▰For disciplinary actions for rank and file employees with imposed penalty of stern warning and below, the respective Department Head concerned shall have the authority to issue the same.

Section 8 -  Administrative disciplinary process

  1. Incident report shall be prepared by the reporting employee to the HR department.

  2. Upon receipt of the Incident Report, the HR Department shall assessed the issue. If the incident requires appropriate action or for clarification, the HR department shall issue a Notice to Explain to the employee concerned on the matter stating therein the necessary facts and details as reported. In addition, referring the matter to the Code of Conduct and stating the appropriate offense deemed violated. The Notice to Explain shall provide the employee the opportunity to answer and explain his side of the issue at least 5 days from receipt thereof.

  3. Upon receipt of the Notice to Explain, the employee concerned shall explain, answer, and submit evidence, if any, as to the allegations contained therein within the prescribed period. The employee may request a clarificatory hearing before the HR department, if necessary. Failure to answer shall waive his right to be heard and shall render the management decide based on available records.
  4. Upon receipt of the employee’s explanation and answer, the HR department in coordination with the Department Head concerned shall evaluate and assessed the circumstances and prepare the necessary recommendation for disciplinary sanction or consideration.
  5. Thereafter, a notice of decision shall be issued to the employee containing therein the gist of the Notice to Explain and the explanation, the conclusion and the appropriate offense violated. It shall also contained the appropriate sanction imposed.
  6. The notice of decision shall be issued to the employee copy furnished the accounting department in cases where the sanction involves suspension, termination, and other concerns requiring appropriate action. The HR department shall see to it that the sanction is implemented.

    The HR department shall ensure that the corresponding notices as above-required are duly received by the employee concerned stating his name, signature and date and time of receipt. Services of such notices must be done personally. If personal service is not possible, it shall be serve either by registered mail or private courier with explanation.

ARTICLE 3: OFFENSES AGAINST COMPANY PROPERTY AND OTHERS

Section 3.0

Any act of vandalism or the malicious or deliberate destruction of property or other things on purpose own by the company guest, employees or removal, defacing, and tearing or altering the content or form of an official poster, tarpaulins, signages, announcement, memo circulars and other official documents posted on the bulletin board.

Sanctions: 

1st Offense  :  4-10 Days suspension

2nd Offense  :  Dismissal with payment of damages

Section 3.1

Robbery/theft/pilferage or attempt, in any form or taking out or attempting to take out company property, products/goods/equipment without proper authority own by the company, co-workers and guests.

Unauthorized, improper, incorrect use of company materials/vehicles or equipment or doing unauthorized work/repair, such as, but not limited to computers, service vehicles or other company-owned or consigned equipment, with or without damage to company property or loss of sales or business opportunities.

Any attempts to hiding or concealing or any attempt thereof of any information/documents/company property or vital company records/reports and statistics, causing breach of confidentiality or damage to the Company, its products, image or operation.

Acts of negligence while at work resulting to injury to persons and/or damage to property, or company image, loss of sales or business opportunities.

Sanctions: 

1st Offense  : 1-3 Days suspension

  2nd Offense  :  4-10 Days suspension

  3rd Offense  :  Dismissal

Section 10.4

Not using Personal Protective Equipment (PPE) while on sanitary operation, such as not wearing safety helmet or hat, goggles, mask, protective gloves and boots.

Sanctions:

1st Offense  :  Warning

  2nd Offense  :  1-3 Days suspension

  3rd Offense  :  4-10 Days suspension

       4th Offense  :  Dismissal

Section 10.5

Unauthorized removal of recyclable material intended for collection by authorized persons.

Sanctions: 

1st Offense  :  Warning

  2nd Offense  :  1-3 Days suspension

  3rd Offense  :  4-10 Days suspension

       4th Offense  :  Dismissal

Section 10.6

Mixing of source-separated recyclable material with other solid waste in any vehicle, box, container or receptacle used in solid waste collection or disposal.

Sanctions: 

1st Offense  :  Warning

  2nd Offense  :  1-3 Days suspension

  3rd Offense  :  4-10 Days suspension

       4th Offense  :  Dismissal

Section 10.7

Improper use, handling and misplacing trash bins or waste storage facilities.

Sanctions: 

1st Offense  :  Warning

  2nd Offense  :  1-3 Days suspension

  3rd Offense  :  4-10 Days suspension

       4th Offense  :  Dismissal
